Welcome to the Lumenair mobile application, developed by Lumenairi LLC (“we,” “us,” or “our” refers to the platform operators collectively). 

By accessing or using the Lumenairi mobile app, you agree to these Terms of Use. 

Please read these terms carefully before using the app.

1. The Services We Provide

The Lumenairi app offers a platform for users to create, share, and engage with content in various formats, including video, images, voice input, text documents, and other digital media. The app allows users to:

• Record and submit video responses.
• Upload images, PDFs, text documents, and voice inputs.
• Interact with AI-generated content, such as follow-up questions, suggestions, and enhanced conversations, based on their submitted media.
• Share their content with other users in the app or via external platforms like social media or email.

Memory Workers LLC is the data controller. Lumenairi Group processes data on behalf of Memory Workers.

2. Your Commitments

By using the Lumenairi app, you agree to:

• Provide accurate, complete, and up-to-date information when creating your account.
• Only upload content that you own or have permission to use.
• Refrain from uploading illegal, harmful, or inappropriate content.
• Follow all applicable laws and respect the rights of other users.

Eligibility: You must be at least 13 years old to use the Lumenairi app. If you are under 18, you must have the consent of a parent or legal guardian.

User Content: Users are responsible for the content they upload, including video responses, images, voice recordings, PDFs, and text documents. By submitting content to the app, you grant Lumenairi Group a non-exclusive, royalty-free, worldwide, perpetual, and sublicensable license to use, modify, adapt, and distribute this content for the purpose of operating and improving the app.

These Terms of Use apply to account holders and contributors. Interviewees whose recordings are uploaded by contributors are governed by a separate consent form and are not required to accept these Terms of Use

3. Content Submission and AI-Generated Content

Lumenairi leverages AI technologies to analyze and generate content based on the media users submit. This can include but is not limited to:

Video responses: Users can submit video recordings that are analyzed and used to generate follow-up questions, suggestions, and conversation enhancements.

Images, PDFs, and Text Documents: Users can upload documents and other digital media, which will be processed to generate AI responses or insights relevant to the content.

Voice Input: Users can submit voice recordings, which will be transcribed and used for AI interactions and content generation.

AI is used only for transcription, translation, tagging, indexing, and search assistance. AI does not alter or change the meaning of any submitted content. Human review is included in quality assurance, and AI-generated outputs may be labeled accordingly.

By submitting content, including video, images, PDFs, text documents, or voice inputs, you acknowledge that AI-generated content may be derived from your submissions. This includes:

• AI-driven follow-up questions and suggestions based on your responses.
• Enhanced conversations or interactions based on the media you provide.
• Recommendations or insights based on your digital content.

All AI-generated content remains the intellectual property of Lumenairi Group, but your original content remains your property. You grant us the necessary rights to use, modify, and distribute AI-generated content for the purpose of improving the app’s services and other business purposes.

Our use of AI follows the Lumenairi Responsible AI Policy, which can be provided upon request.

4. Data Collection and Protection

We collect, store, and process your content, including video, images, PDFs, text documents, and voice inputs, in accordance with our [Privacy Policy]. We implement reasonable security measures to protect your data from unauthorized access or disclosure. However, no system is entirely secure, and we cannot guarantee absolute protection of your content.

Your content may be used for the following purposes:

• To generate AI-driven responses, insights, and suggestions.
• To enhance user interactions within the app.
• To improve the app’s features and functionality.

We ensure that all submitted content is treated with respect to privacy and security. Any unauthorized use or sharing of your content outside of these Terms of Service will not be permitted.

5. User Conduct

By using the Lumenairi app, you agree not to:

• Upload any content that is illegal, harmful, or otherwise inappropriate.
• Impersonate another person or entity.
• Engage in activities that could disrupt or degrade the app’s performance or other users’ experiences.

Users can select visibility settings for each recording, including private, channel-only, or public. Public content may be reviewed before publication, and pseudonymous participation is supported.

We reserve the right to remove content that violates these Terms of Service or is otherwise inappropriate. Repeated violations may result in account suspension or termination.

6. Rights You Grant Us

By submitting content to Lumenairi , you grant us a license to:

• Use, display, modify, and distribute your content as necessary for the operation and improvement of the app.
• Generate and distribute AI-generated content based on your submissions.
• Share your content, including AI-generated responses, within the app or on external platforms (e.g., social media) with your consent.

This does not affect the copyright ownership of interview recordings for the archive, which is held by Memory Workers and governed by the separate consent form.

7. Your Rights

You retain ownership of any content you submit, including video responses, images, text documents, PDFs, and voice inputs. However, by using the app, you grant us permission to use, modify, and distribute your content as described in these terms. If you delete content or your account, it may remain on our servers for a period of time in accordance with our data retention policy.

Deletion rights apply only to contributors removing their own uploads. Interview recordings collected with a signed consent form are governed by that consent form and may not be deleted on request. Deleted content may remain in system backups for 30 to 90 days.

8. Account Termination

We may suspend or terminate your account if you violate any of these terms, including submitting illegal, harmful, or inappropriate content. If your account is terminated, your access to the app and your content may be restricted.

9. Changes to These Terms

We reserve the right to modify these Terms of Service at any time. If we make significant changes, we will notify you within the app. Continued use of the app after any changes are posted constitutes your acceptance of the revised terms.
